These Terms and Conditions ("Terms") govern your access to and use of the SugarPot mobile application, website, and related services (collectively, the "Service"), operated by SugarPot ("we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

  • You must be at least 18 years old to use SugarPot.
  • You represent that all registration information you submit is accurate and truthful.
  • You may use the Service only in compliance with applicable laws.

2. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your account credentials and access to your device/email used for login.
  • You are responsible for all activities that occur under your account.
  • You must notify us promptly if you suspect unauthorized use of your account.
  • We may suspend or terminate accounts that provide false information or violate these Terms.

3. Nature of the Service

SugarPot is a social/dating platform that may include:

  • profile creation and editing;
  • location-based profile discovery and matching;
  • heart/like/pass interactions;
  • match-based messaging, including text and media;
  • account management tools (for example, hide profile, report, unmatch, or delete account).

We do not guarantee that any match, conversation, meetup, or relationship outcome will occur.

4. User Content and Conduct

4.1 Your Content

You may upload or submit content such as profile details, photos, audio/video/media, messages, and reports ("User Content").

You retain ownership of your User Content. By submitting User Content through the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, display, and distribute that content solely for operating, improving, securing, and providing the Service.

4.2 Prohibited Conduct

You agree not to:

  • impersonate any person or misrepresent your identity;
  • post illegal, abusive, harassing, threatening, hateful, discriminatory, pornographic, or otherwise harmful content;
  • send spam, scams, or deceptive messages;
  • share another person's personal data without authorization;
  • use bots, scrapers, reverse engineering, or unauthorized automation;
  • upload malware or attempt to disrupt the Service;
  • use the Service for any unlawful activity.

We may remove content or restrict accounts that violate these Terms.

5. Safety and User Interactions

  • You are solely responsible for your interactions with other users, online and offline.
  • Use caution when sharing personal information.
  • Meeting another user in person is at your own risk.
  • We do not conduct criminal background checks on all users and do not guarantee user behavior.

If you feel unsafe or see violations, use in-app reporting tools and/or contact local law enforcement when appropriate.

6. Messaging and Media

  • Chats and media features are provided for user communication.
  • You must have rights to share any media you upload.
  • You are responsible for ensuring your communications comply with law and these Terms.
  • We may apply technical limits (for example file size, format, storage, or retention limits) to maintain performance and security.

7. Privacy

Your use of the Service is also governed by our Privacy Policy (if provided separately), which explains how we collect, use, and protect your information.

8. Intellectual Property

  • The Service, including software, branding, logos, design, and compiled content (excluding User Content), is owned by SugarPot or its licensors and protected by applicable intellectual property laws.
  • You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except as expressly permitted by law or by us in writing.

9. Third-Party Services

The Service may rely on third-party tools or providers (for example cloud hosting, notifications, analytics, maps/location, media processing, or authentication). Your use of such integrated functionality may also be subject to third-party terms and privacy practices.

We are not responsible for third-party services beyond our reasonable control.

10. Account Suspension and Termination

We may suspend, limit, or terminate your access to the Service at our discretion if:

  • you violate these Terms;
  • your conduct creates risk, harm, or legal exposure for users or us; or
  • we are required to do so by law.

You may stop using the Service at any time and may request account deletion through available account settings/features.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that:

  • the Service will always be secure, available, or error-free;
  • data will never be lost, delayed, or corrupted; or
  • any user behavior or identity is fully verified.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUGARPOT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REPUTATION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT PAID BY YOU TO US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM; OR
  • INR 5,000.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless SugarPot and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

  • your use of the Service;
  • your User Content; or
  • your violation of these Terms or applicable law.

14. Changes to the Service or Terms

We may modify these Terms from time to time. When we do, we will update the "Last Updated" date and may provide additional notice where required by law.

Your continued use of the Service after changes become effective means you accept the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

You agree that courts located in Chandigarh, India shall have exclusive jurisdiction over disputes arising out of or related to these Terms or the Service, unless otherwise required by applicable consumer law.
